When only eight justices decide a case, there is a good possibility that some significant issues will end with a tie decision. When that happens, the previous court’s decision is allowed to stand, wasting taxpayer money and years of waiting while also dashing the hopes of those who’d expected a fair ruling by the nation’s highest court.
